Terms of Service

Effective Date: January 1, 2026

Article 1 (Purpose)

These Terms of Service govern the use of the FitTalk mobile application (hereinafter "Service") provided by MCA Co., Ltd. (hereinafter "Company").

Article 2 (Definitions)

  1. "Service" refers to all fitness coaching services provided through the FitTalk mobile application.
  2. "User" refers to anyone who uses the Service under these Terms.
  3. "Subscription" refers to the paid membership service.

Article 3 (Effect and Amendment of Terms)

  1. These Terms become effective when displayed within the app or otherwise notified to users.
  2. The Company may amend these Terms when deemed necessary, and will notify users at least 7 days in advance.

Article 4 (Service Content)

  1. The Company provides the following services:
    • Voice-based AI fitness coaching
    • Personalized workout guidance and feedback
    • Workout history management and statistics
  2. Service content may be changed or added without prior notice.

Article 5 (Subscription and Payment)

  1. Users may subscribe to paid services through in-app purchases.
  2. Subscription fees are charged through the App Store or Google Play Store.
  3. Subscriptions auto-renew unless canceled before the renewal date.
  4. Refunds are processed according to App Store and Google Play Store policies.

Article 6 (User Obligations)

Users shall not:

  • Use the Service for illegal purposes
  • Infringe on others' rights or interfere with Service operations
  • Reproduce, distribute, or commercially use Service content without permission
  • Attempt to reverse engineer or hack the Service

Article 7 (Health and Safety Disclaimer)

  1. The Service does not provide medical advice.
  2. Users should consult a healthcare professional before starting any exercise program.
  3. The Company is not liable for injuries resulting from exercise performed through the Service.

Article 8 (Intellectual Property)

  1. All intellectual property rights to the Service belong to the Company.
  2. Users may not copy, modify, or distribute content provided through the Service.

Article 9 (Limitation of Liability)

The Company is not liable for damages caused by:

  • User negligence or misuse
  • Force majeure events
  • Actions of third parties

Article 10 (Privacy)

  1. The Company handles user personal information in accordance with the Privacy Policy.
  2. Users may check the Privacy Policy within the app at any time.

Article 11 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by the laws of the Republic of Korea.
  2. Any disputes arising from the Service shall be subject to the exclusive jurisdiction of the Seoul Central District Court, Republic of Korea.

제1조 (목적)

이 약관은 MCA Co., Ltd.(이하 "회사")이 제공하는 AI 음성 피트니스 서비스 FitTalk(이하 "서비스")의 이용과 관련하여 회사와 이용자 간의 권리, 의무 및 책임사항을 규정함을 목적으로 합니다.

제2조 (정의)

  1. "서비스"란 회사가 제공하는 AI 기반 음성 피트니스 코칭 서비스를 말합니다.
  2. "이용자"란 본 약관에 따라 서비스를 이용하는 자를 말합니다.
  3. "구독"이란 서비스의 유료 기능을 이용하기 위한 정기 결제를 말합니다.

제3조 (약관의 효력 및 변경)

  1. 본 약관은 서비스 화면에 게시하거나 기타의 방법으로 이용자에게 공지함으로써 효력이 발생합니다.
  2. 회사는 관련 법령을 위배하지 않는 범위에서 본 약관을 변경할 수 있으며, 변경 시 최소 7일 전에 이용자에게 공지합니다.

제4조 (서비스의 제공)

  1. 회사는 다음과 같은 서비스를 제공합니다:
    • AI 음성 피트니스 코칭
    • 운동 기록 및 분석
    • 개인화된 운동 추천
  2. 서비스 내용은 사전 공지 없이 변경되거나 추가될 수 있습니다.

제5조 (구독 및 결제)

  1. 이용자는 인앱 구매를 통해 유료 서비스를 구독할 수 있습니다.
  2. 구독 요금은 앱스토어 또는 구글 플레이스토어를 통해 청구됩니다.
  3. 구독은 갱신일 전에 취소하지 않으면 자동으로 갱신됩니다.
  4. 환불은 앱스토어 및 구글 플레이스토어 정책에 따라 처리됩니다.

제6조 (이용자의 의무)

이용자는 다음 행위를 하여서는 안 됩니다:

  • 불법적인 목적으로 서비스를 이용하는 행위
  • 타인의 권리를 침해하거나 서비스 운영을 방해하는 행위
  • 허가 없이 서비스 콘텐츠를 복제, 배포 또는 상업적으로 이용하는 행위
  • 서비스를 역설계하거나 해킹을 시도하는 행위

제7조 (건강 및 안전 면책조항)

  1. 본 서비스는 의료 조언을 제공하지 않습니다.
  2. 이용자는 운동 프로그램을 시작하기 전에 의료 전문가와 상담해야 합니다.
  3. 회사는 서비스를 통해 수행된 운동으로 인한 부상에 대해 책임지지 않습니다.

제8조 (지적재산권)

  1. 서비스에 대한 모든 지적재산권은 회사에 귀속됩니다.
  2. 이용자는 서비스를 통해 제공되는 콘텐츠를 복사, 수정 또는 배포할 수 없습니다.

제9조 (책임의 제한)

회사는 다음으로 인한 손해에 대해 책임지지 않습니다:

  • 이용자의 과실 또는 오용
  • 불가항력적 사건
  • 제3자의 행위

제10조 (개인정보)

  1. 회사는 개인정보처리방침에 따라 이용자의 개인정보를 처리합니다.
  2. 이용자는 앱 내에서 언제든지 개인정보처리방침을 확인할 수 있습니다.

제11조 (준거법 및 관할법원)

  1. 본 약관은 대한민국 법령에 따라 규율되고 해석됩니다.
  2. 서비스 이용과 관련하여 분쟁이 발생한 경우 서울중앙지방법원을 관할법원으로 합니다.
